The short answer is that a divorce in Texas takes a minimum of 60 days. However, the reality involves a few more steps than just waiting out the clock. Here is a breakdown of what that timeline actually looks like when you work with me.
The Mandatory 60-Day Waiting Period
Texas law requires a “cooling-off” period. Once I file your Original Petition for Divorce with the court, the clock starts ticking. The court cannot grant your divorce until at least 60 days have passed from that filing date.
This rule applies to almost everyone, with very few rare exceptions involving family violence. So, even if you and your spouse agree on absolutely everything, custody, property division, and support, we still have to wait two months before a judge can sign the final decree.
What Happens During those 60 Days?
Just because we are waiting doesn’t mean we are idle. During this time, I work closely with you to ensure all the paperwork is perfect. In an uncontested divorce, the goal is to have the Final Decree of Divorce drafted, reviewed, and signed by both parties so it is ready to present to the judge on day 61.
If we have the agreement ironed out early, the wait is just a formality. If there are still minor details to negotiate, we use this time to finalize them without the pressure of a looming trial date.
When Can It Take Longer?
While 60 days is the minimum, it isn’t a guarantee. The process can take longer if:
- The court’s docket is full, making it hard to get a hearing date immediately.
- You and your spouse struggle to agree on specific terms, turning an uncontested case into a contested one.
